Illinos Preneed Scam seeks appeal in Court-Your Funeral Guy

Over a year and a half ago Icanceled my membership in Illinois Funeral Directors Association. Paying an organization that questionably handled folks  funeral preneed funds  to the tune of nearly 100 million dollars is simply something I could not do!

Recently because of other questionable actions the judge has stated that the insurance company for the Illinois Funeral Directors Association did not have to insure the debacle,  theft or ponzi scheme. Now it appears that the IFDA, Illinois Funeral Directors Association is appealing that decision.

The Illinos Funeral Directors Association has decided to appeal a federal judge’s ruling that IFDA’s insurer would not be responsible for claims resulting from litigation surrounding the association’s beleaguered Master Trust …………

“Our lawyers believe that there are several arguments that can be made during the appeal that may allow for this ruling to be overturned,” said Duane Marsh, IFDA executive director. He noted that the appeal process can take up to 12 months depending upon the court’s schedule.

Illinois Funeral Directors Preneed Scam|task force Reports-YourFuneralGuy

The Governors Task Force Association The Illinois Funeral Directors Association has reported and has recommended that the Illinois Department of  Financial and Professional Regulation handle preneed regulation.

Up to regulation of Funeral  Preneed funds has been handled by the comptrollers office of the State of Illinois. 100 million dollars is now gone from the preneed fund mainly because of funky and maybe fraudelant insurance investments. There was also extracurricular use of the Preneed fund including the Setup and administration of the Museum Of Funeral Customs by the now NFDA  Treasurer  Randal L Earl. There was also loans to board members through IFDA Services.

To the greatest extent possible, Illinois should have a fully consolidated regulatory scheme,” the report’s authors wrote.

In addition, the task force recommended:

*Restrictions on what investments can be made with money in pre-need funeral trusts.

“The investment of those funds should be strictly limited to U.S. government-backed securities or other investments of equal creditworthiness,” the authors wrote.

*A ban on pre-need funeral trustees engaging in business unrelated to pre-need funerals.

The IFDA made loans to funeral directors from the pre-need trust fund and also operated a museum, which is now closed. The task force wrote that the IFDA “may have deviated from its original purpose” and may have made investments and loans that “further detracted from its core mission.”

*A requirement for transparency in the administration of pre-need funeral trusts.

Duane Marsh, IFDA executive director, could not be reached for comment.

Illinois Funeral Directors Association|President, Merrill Lynch Resign-YourFuneralGuy

The Illinois Funeral Director Association President has resigned. Merrill Lynch the embattled ” IFDA Preneed Trust”  trustee has also pulled out. This  may be the Full collapse of the IFDA  Illinois Funeral Directors Association as predicted here. Time will tell.

In April I sat down with the  new IFDA  President Chris Woodridge who was enthusiastic about pulling the Illinois Funeral Directors Association out of the scandal. I had my doubts then. Those doubts have been confirmed with the Woodridge resignation for “personal reasons”.

This looks like a death blow, because  Chris Woodridge was trying to build a new IFDA. That appeared to be doomed because the Former IFDA Presidents James D.Bosma and Charles Childs JR stayed on the board. Both these individuals were named in the press and in the lawsuits.

Linda Allen will be the new IFDA President but her alliances in this politically charged situation are not known.

Duane Marsh a man with limited understanding of the politics and the History of the scandal as well as the politics:( of the State of Illinois remains executive director.

It appears that with Merrill Lynch (Wall Street bad boy)pulling out of the situation leaves the YEARS of  work of Comptroller Dan Hynes To resolve the IFDA  Preneed Trust Scandal and ponzi scheme in the trash can.

In 2007 and most of 2008  I was the only one reporting on the IFDA Preneed Trust Scandal. In 2009 Bruce Rushton of the The Springfield Journal Register newspaper reported till August  in detail on the 42-100 million theft-loss-misappropriation of the IFDA Preneed Trust Ponzi Scheme.

Charles Childs Jr is a known protege of Jesse Jackson Sr and an Illinois Funeral regulator for the State.

I have asked current Illinois Funeral Director’s Association Executive Director to respond to my posts on the IFDA Preneed Trust Ponzi Scheme(scandal). As the new director of an association that brought about the largest insurance scheme  in the State of Illinois history you would think he would have responded with a yes.

Dear Funeral Guy,
It has been along time since we’ve had a chat. With all of the “special events” going on here in the Land of Lincoln, IFDA Trust, NPS, Burr Oaks, Mr. Hynes running for Governor, (the man can’t run his own office and wants the run the entire State, what a hoot!), I have been busy taking care of families and trying to enjoy my own, that I just haven’t had time to talk.

After reading today’s blog, I need to take issue with you on a few matters regarding IFDA. While IFDA may not be at the top of its game and an embarrassment to the funeral service community, there have been some important changes to the IFDA Board. There are some fresh faces and along with those come some minds to change things and set a course that hopes to rebuild the integrity of the Association for it’s membership and those in the funeral service community and the public that its members serve. If one is paying attention you will notice in comparing the past Board members names to those recently installed this past summer and the fact that most of them have no prior connection to the IFDA you have “fresh” people on board. The holdovers, are in the minority and the majority of them from what I am told is working with the newcomers to make positive changes. I am told that good things will be coming from this group.

Secondly, I have been extremely critical of the IFDA Trust mess. While it is true that a new Trustee is being sought, it will be difficult to find any entity to take over until the smoke clears and the dust settles on the lawsuits to see if there is recoupment of monies or not, if so what percent of recovery, etc. One can almost be assured that Merrill-Lynch(ed) as I like to call them, has been eager to dump this prior to merging with Bank of America. As I have said before hopefully the Courts will hold the investment arm of Merrill-Lynch accountable along with their commission earning poster child Mr. Schainker, et.al., in the recoupment of Trust monies. The regulators are learning it is wise for them to keep their noses out the matter in making back-room deals with ML while matters are in litigation.

Number three, you need to lay off the new Executive Director of IFDA, Mr. Duane Marsh. He is NOT the one you need to be slamming here. There are a few out there that you could slap around if you like. Mr. Marsh is reaching out to our membership to build relationships and regain the trust of individuals to rebuild IFDA. You have to remember that this man walked into a firestorm of problems some which occurred after he came on as the result of the actions of his predecessors. With all of the problems going on I don’t think the man has had a chance to focus on his job for having to deal with all of the little fires around him.

7 Reasons Why IFDA-Executive Director must Go|Your Funeral Guy

ifda_logo_consHere are 7 reasons why the Executive Director of the Illinois Funeral Directors Association Must Leave.

1. He sided with the the Corrupt Illinois Funeral Director Lobbyist,  Illinois Senator Roland Burris defending the Lobbyist Efforts on behalf of the association in Statements.

2. He did not call out Former IFDA President Charles Childs Jr.(Reverend Jesse Jackson Protege) on his misappropriation( theft) of Management Fees out of the IFDA Preneed Trust Fund moved to IFDA Srvices

3. He did not recognize the threat of Merrill Lynch Bank and Trust (Trustee) to the IFDA Preneed Trust. MLBT was indeed a key player in the Wall Street Crash and corruption. MLBT wrote Down the value of the IFDA Preneed Trust in 2009

4. Instead of cooperating with the Regulator, The Illinois Comptroller, he fought the regulator, resulting in the Comptroller declaring the IFDA stole millions  from the Trust and fining the IFDA  Services, Inc almost 10 million Dollars(there is a lawsuit on this one.)

5. After years of Search  for a trustee, under Duane Marsh the Illinois Funeral Directors Association again has to find a trustee for the IFDA  Preneed Trust.

6. He Duane Marsh did not  call out Randall L. Earl(NFDA Executive Secretary, gasp, choke) in his acceptance of Preneed Trust Funds for the Museum of Funeral Customs. Marsh affectionately refers to Earl as Randy!

7. There is the same lack of integrity (arguably more )for the Illinois Funeral Directors Association as when Duane Marsh arrived as executive  director.

thumbnail (6)The Illinois Funeral Directors Association appears not do be doing so well. They have are searching for a new trustee, for their Scandal ridden trust fund, The IFDA Preneed Trust. They have not been updating their member website. (latest info has been from June 2009 ) After Losing and stealing up to 100 million dollars of  preneed trust funds(according to Illinois Comptroller Dan Hynes and reports in the State Journal Register) one would think that would be the least they could do.

Instead The Executive Director Duane Marsh has been busy conducting tours of the Museum of Funeral Customs. directed by the embattled National Funeral Directors Association Executive Secretary Randall L Earl.( yes he is still listed as the Director of the Museum pf Funeral Customs at The NFDA website)

The press seems to have forgotten about the Illinois Funeral Directors Association and their great preneed insurance  swindle in the State of Illinois
