It is best to continue the warning to avoid Preneed, Prepaid Funeral Plans. Your Funeral Guy has been warning about the Perils of Preneed for years, it all began in Bloomington, Illinois when I heard a Preneed Director say “I am going in for the Preneed Kill”.

I wrote a chapter in the Book Rest in Peace Insiders Tips to he Low Cost Less Stress Funeral on this subject. Now reporters and bloggers around the world have taken to warning about the Prepaid Funeral.

The warning about Funeral Directors taking Your Money was sounded loudly by the Illinois Funeral Directors Association  Preneed Scandal and the larger National Prearranged Services(NPS) Scandal. See the Blog  Post “Who Shot Funeral Preneed?”

New Research on Illinois Funeral Scam|Your Funeral Guy

There is new Research available on the Illinois Funeral Director’s Association (IFDA)Preneed Funeral Trust Scandal. Here is a guest post by free lance journalist-Heather Stanke

The Illinois Funeral Directors Association is currently involved in class action lawsuits regarding the mismanagement of a pre-need trust fund, which resulted in the loss of $59 million of trustee funds. As a result of the mismanagement, funeral directors have had to cover the losses and still perform all guaranteed funeral services for their clients.  Each time funds are misused, the costs of funerals are raised.  The situation has caused an integrity problem for the funeral home industry.

The fund was set up in 1980, by then comptroller Roland Burris, the current junior Senator of Illinois. He illegally issued a license for the fund, and later lobbied for it. IFDA members deposited money into the fund from pre-need sales and it was invested by the trustees. Burris has been subpoenaed in a current lawsuit the IFDA is facing, asking him to come forth with any documents relating to the fund and figures of how much he was paid to lobby state regulators.  In 2009, the IFDA reported 49,000 policies with $300 million in assets, according to the IFDA.

Much of that money, over $190 according to the lawsuit, was invested irresponsibly in life insurance policies, under the recommendation of Ed Schainker, an investment advisor for Merrill Lynch.

Shainker’s powers to advise and sell insurance were suspended by Secretary of State Jesse White on February 25, 2009.  The order of suspension says that while he was acting as advisor, Shainker sold over 300 insurance contracts to the IFDA.  One hundred and twenty of those contracts were from Merril Lynch, for which he earned millions of dollars in commissions.  The insurance policies were taken out on the lives of IFDA board members, directors and officers.  They have been losing the fund money because those people aren’t dying fast enough.  Shainker didn’t analyze the purchases beforehand to predict this occurrence.

In 2007, an independent audit reported the fund at a deficit of $39 million, a direct result of the insurance policies not being paid out.  The IFDA’s license to act as trustee of the fund was revoked by comptroller Dan Hynes.  In 2008, Merril Lynch took over as trustee of the fund, after Regions Bank declined the offer.

In October 2008, the IFDA website told consumers in a Q&A section, that they should feel perfectly confident in buying pre-need funerals.  Some homes continue to recommend pre-need services to clients. Darcy Kolschefski is a pre-need funeral counselor at Hultgren Funeral Home in Wheaton, IL.  He said that only 30 of his 4,000 pre-need cases use the trust anyway, and that no matter what, the consumer receives their services.  He said that funeral homes across the state have signed a pact agreeing to try to recoup losses incurred by the trust.

Hultgren uses a re-insurance pool akin to the IFDA for their policies, and still recommends pre-need because it keeps the home from having to finance the funeral while the family waits to gather funds to pay it.

In November(2008), two women who had purchased pre-need funeral contracts filed suit against the IFDA, and on January 28, 2009, a second lawsuit was filed.  The second was by six funeral directors affected by the losses.  The case is likened to a Ponzi scheme, in which returns are paid to investors from their own money or other investors’ money, not from profits earned

Illinois Funeral Directors Preneed Scam|task force Reports-YourFuneralGuy

The Governors Task Force Association The Illinois Funeral Directors Association has reported and has recommended that the Illinois Department of  Financial and Professional Regulation handle preneed regulation.

Up to regulation of Funeral  Preneed funds has been handled by the comptrollers office of the State of Illinois. 100 million dollars is now gone from the preneed fund mainly because of funky and maybe fraudelant insurance investments. There was also extracurricular use of the Preneed fund including the Setup and administration of the Museum Of Funeral Customs by the now NFDA  Treasurer  Randal L Earl. There was also loans to board members through IFDA Services.

To the greatest extent possible, Illinois should have a fully consolidated regulatory scheme,” the report’s authors wrote.

In addition, the task force recommended:

*Restrictions on what investments can be made with money in pre-need funeral trusts.

“The investment of those funds should be strictly limited to U.S. government-backed securities or other investments of equal creditworthiness,” the authors wrote.

*A ban on pre-need funeral trustees engaging in business unrelated to pre-need funerals.

The IFDA made loans to funeral directors from the pre-need trust fund and also operated a museum, which is now closed. The task force wrote that the IFDA “may have deviated from its original purpose” and may have made investments and loans that “further detracted from its core mission.”

*A requirement for transparency in the administration of pre-need funeral trusts.

Duane Marsh, IFDA executive director, could not be reached for comment.

Merrill Lynch back on the Hook for Illinois Funeral Scam|YourFuneral Guy

Merrill Lynch is back on the Hook for the Illinois Funeral Scam. That would be the Illinois Funeral Directors Association(IFDA)  Preneed Trust Scandal. The 18 million dollar payment agreement  regulators took in return for no further investigations has been thrown out by  a  Cook County Judge.

A Cook County judge has ruled that state regulators overstepped their authority last spring when they extracted $18 million from Merrill Lynch to settle allegations that the financial giant violated state law in its dealings with the Illinois Funeral Directors Association.

Earlier this month, the Department of Insurance amended the settlement agreement so funeral directors can draw from the $18 million fund without releasing Merrill Lynch from liability. Anjali Julka, department spokeswoman, said the revised order could result in “immediate distribution” of the $18 million to funeral directors.

Illinois Comptroller Hynes Fires back to Gov. Quinn on the Illinois Funeral Scandal-YourFuneralGuy

In Illinois Dan  Hynes the candidate for Governor has fired back  At Gov. Quinn’s Allegations on the Illinois Funeral Directors Association Ponzi Scheme.

As expected the Governor gave The Illinois Comptroller  Hynes a hard time for  his handling of the Illinois Funeral  Directors Association Ponzi Scheme where over 100 Million Dollars was lost. Funeral Directors in the  State are out lots of money,Funeral prices have risen because of this Insurance Scam &  the sale of prepaid insurance in the State has lost all integrity.

IFDA Trust Fund is an issue in the Governors race.

Hynes also addressed allegations from the Quinn campaign that he allowed a funeral trust fund scam to flourish under his watch.

Hynes said his office looked into the matter thoroughly and took awhile to complete an investigation because problems began more than a decade before he took office and grew complex before they were caught.

“We uncovered the fraud and put an end to it,” Hynes said. “This was a complicated scheme that began in the early ’80s.”

Hynes did uncover the Fraud. Putting an end to it remains to be seen.

Dan Hynes let the Illinois Funeral Directors Association go to Civil Lawsuit in hopes that the public may benefit. Your Funeral Guy Believes that the matter should have been sent to prosecutors  so the Ponzi Scheme could have been brought to a quick end for good.

The Illinois Governor Called the Illinois Funeral Directors Ponzi Scheme a 8 year cover up by his opponent The Illinois Comptroller  Dan Hynes. Quinn also refered to the IFDA  Preneed Trust Scandal  as  a Madoff Like Scheme -something I have been saying for years.

Revealed Here are the  top 3 Funeral Scandals of 2009 with detailed explanations. Front and center in these Scandals are Service Corporation International, the Illinois Funeral Directors Association,  the National Funeral Directors Association’s Treasurer and  Perpetua, Inc the owner of  the Burr Oak Cemetery.

Burr Oak Cemetery Scandal

1. The Most significant and Far Reaching Funeral(& Cemetery) Scandal of 2009 was the Burr Oak Cemetery Scandal outside of Chicago. (Alsip, IL) In July 2009 it was discovered that over 300 graves had been moved and  desecrated. Bones were piled up and scattered throughout the cemetery. Four people were arrested for grave desecration. Next to the Georgia Tri State  Crematory  Scandal(2002) and  The Service Corporation International Menorah Gardens &  Funeral Chapels 2001 Scandal in West Palm Beach FL, this is probably the worst Funeral and Cemetery Scandal in the ending  decade. The owner of the neglected Cemetery, Perpetua Inc has escaped consequences along with the Funeral Homes involved on The South side of Chicago.

Good things have come out of this Scandal: Cemetery reform is on the way in Illinois and nationally  The Bereaved Consumers Bill of Rights Act was proposed in Congress.

2. On the heels of the Burr Oak Cemetery Scandal came the Eden Memorial Park Scandal in Los Angeles. This is a Service Corporation International Cemetery were over 500 graves were either moved or desecrated. 3. In 2009 the Illinois Funeral Directors Association Insurance Ponzi Scheme was brought into the Light. They lost 42 million dollars before the Wall Street melt down in 2008. Losses have ballooned to over 100 million dollars The leaders of the association misappropriated the  preneed trust funds (IFDA Preneed Trust).

The Comptroller of the State of Illinois in 2009  stated in a press release that the leaders of the association stole the money.  One of the Main players in the scandal is Randall L Earl current treasurer of the NFDA, who has refused to resign his position despite his involvement.

Sadly those Funeral Directors( Lawsuit Calvert Funeral Homes et al) that sued the association over their preneed commissions did not do due diligence with their families preneed funds. They did not keep track of the money themselves, their responsibility. Instead they blamed their association and filed lawsuits.

A consequence of the Illinois Funeral Directors(IFDA)Scandal is a lack of Funeral jobs in the State. Unemployed Funeral Directors and Mortuary Students.  Because of the cuts in payouts out of the IFDA  Preneed Trust (commissions) many funeral home owners will be working past retirement in the State.

The result of this lack Of Income is a lack of Jobs. The Fact that Merrill Lynch is withdrawing as the trustee for the IFDA  preneed trust  makes the situation all the worse.

Randall Hulgren is running for Congress

One of the reasons for the current Funeral Industry demise is Funeral Scandal. Funeral Directors claim that the press sensationalizes their scandals. If you go into a funeral home to do a funeral they will say others are  not dishonest, and that their home here in anytown is honest one. This may not be the case.

An example of this is Illinois where in spite of a 100 million dollar scandal many homes continue to do business with the Illinois Funeral Directors Association who misappropriated, lost stole ?40 million dollars before the market crash in 2008 .The losses have ballooned to over 100 million in 2009.

SADLY IT IS NOT SENSATIONAL BECAUSE FUNERAL SCANDAL HAS POLITICAL CONNECTIONS. In Illinois the connections go to Randall Hultgren and Roland Burris.

Some state leaders like State Senator Randall  Hultgren have given support by not speaking up. Hultgren hails from a funeral director family.

Many Funeral homes in Illinois continue to do business with the IFDA in spite of the Scandal. One Funeral home that has quietly supported the Illinois Funeral Directors Association is Hultgren Funeral Home. Randall Hultgren was originally elected to office with his fathers preneed money as a State representative and later a State Senator. On the State insurance committee  in the State Senate, He did not even weigh in on the Illinois Funeral Directors Scandal the largest in the State Senate. Now it appears he is running for Congress.

Randall Hultgren is mentioned here because he is running for Congress. Hultgren Funeral Home is mentioned here because they actively support the Illinois Funeral Directors Association (Scandal reported in the press) and Randy Hultgren throughout his political career.

My advice, do not vote for Hultgren. Do not use their funeral home, or prepay through the Illinois Funeral Director Association or anywhere else.

Illinois Funeral Directors Association|President, Merrill Lynch Resign-YourFuneralGuy

The Illinois Funeral Director Association President has resigned. Merrill Lynch the embattled ” IFDA Preneed Trust”  trustee has also pulled out. This  may be the Full collapse of the IFDA  Illinois Funeral Directors Association as predicted here. Time will tell.

In April I sat down with the  new IFDA  President Chris Woodridge who was enthusiastic about pulling the Illinois Funeral Directors Association out of the scandal. I had my doubts then. Those doubts have been confirmed with the Woodridge resignation for “personal reasons”.

This looks like a death blow, because  Chris Woodridge was trying to build a new IFDA. That appeared to be doomed because the Former IFDA Presidents James D.Bosma and Charles Childs JR stayed on the board. Both these individuals were named in the press and in the lawsuits.

Linda Allen will be the new IFDA President but her alliances in this politically charged situation are not known.

Duane Marsh a man with limited understanding of the politics and the History of the scandal as well as the politics:( of the State of Illinois remains executive director.

It appears that with Merrill Lynch (Wall Street bad boy)pulling out of the situation leaves the YEARS of  work of Comptroller Dan Hynes To resolve the IFDA  Preneed Trust Scandal and ponzi scheme in the trash can.

Charles Childs Jr is a known protege of Jesse Jackson Sr and an Illinois Funeral regulator for the State.
