If its no lameduck pass- No Bereaved Consumers bill of Rights Act-YourFuneralGuy

If the Bereaved Consumers Bill of Rights act does not pass the 2010 lame duck Congress. Odds are it will not happen at all. The Bill has not been scheduled for a House Vote. The Bill Hr 3655  a cemetery legislative reform bill bringing some cemeteries under the FTC Funeral Rule.

Cemetery reform is definetley needed after the Burr Oak Cemetery and Eden Memorial Park Scandal of  2009. These are horror stories beyond comprehension.

In this year of real political confusion, these basic needed reforms may fall by the way side!

The bill has engaged Democratic support but Republican Opposition.

The Bereaved Consumers Bill of Rights Act costs 23 cents per family. That is Washington Watch’s breakdown on the Cemetery reform legislation(from the CBO-Congressional Budget Office- Report) also known as the Bereaved Consumers Protection Act.

The legislation will extent the funeral rule to cemeteries and funeral vendors.

The Congressional Budget Office(CBO) has issued a report on HR3655 The Bereaved Consumers Bill of Rights Act.  This is also known as Funeral Rule 2.

The Bill Essentially will require cemeteries to operate under the funeral rule. Cemetery records on a computer are required. Price disclosures to consumers will be a requirement of Law.

This will prevent Cemetery scandals like those that occurred recently at Burr Oak Cemetery and Eden Memorial Park, a Service Corporation International Firm.

This legislation will bring significant needed reform to death care. The CBO Report brings the Legislation  HR3655 a step closer to full US House of Representative Passage

“Based on the information from the FTC CBO assumes would require five additional positions at a cost of 1 million per year to develop, enforce the new requirements,  train staff and develop education materials.”

Help Pass The Bereaved Consumers Bill of Rights Act|Your Funeral Guy

Tomorrow the Bereaved consumers Bill of Rights Act of 2009 comes up for a hearing, before the House Energy and Commerce Committee. There will be a vote to move the legislation to a full house vote.

This legislation (HR 3655)will be good for the Funeral Consumer and the Funeral Industry as a whole. The legislation is known as the Rush Bill or Funeral Rule 2.

Today.you can call and file a complaint with the FTC  about a Funeral Home. As of today You cannot file a complaint against a cemetery, or certain third party funeral and cemetery providers. Last July I received a call from a governmental authority investigating the Burr Oak Cemetery Scandal. I had to tell the attorney on the line that there was essentially no effective State Regulation and No Federal Regulation that  Existed for the tragedy at Burr Oak Cemetery outside of Chicago.

Contact Congress today, stop these tragedies and let there be a place (The Federal Trade Commission) where Folks can File a Complaint if they have a problem with a grave or cemetery!

Funeral and Cemetery reform moving through Congress.

Breaking News-Funeral and Cemetery Reform Moved closer to passage in the US Congress yesterday, The Bereaved Consumers Bill of Rights Act moved from the House Subcommittee,to the Full Energy and  Commerce Committee in the US House of Representatives. This bill will bring positive changes to the Funeral Industry by bringing cemeteries and Third party Vendors under the Funeral Rule.

The Bill states that a seperate rule would be created for cemeteries, and sellers of funeral goods and burial services.  This bill was written in reaction to the Burr Oak Cemetery Scandal.  If passed the legislation should prevent another Burr Oak Cemetery Scandal from occurring in the United States.

The Bereaved Consumers Bill Of Rights Act is moving through Congress.

In a mark-up meeting today, the House Subcommittee on Commerce, Trade and Consumer Protection voted to send the “Bereaved Consumer’s Bill of Rights Act of 2009″ (H.R. 3655) to the full House Energy and Commerce Committee for consideration, moving it one step closer to passage. (A mark-up is the part of the legislative process during which the committee with jurisdiction over the bill reviews, amends and approves it, preparing it for consideration by the full House of Representatives.) The bill, which was introduced by Rep. Bobby Rush, D-Ill., would require the Federal Trade Commission (FTC) to initiate a separate rule that would cover cemeteries and all other sellers of funeral or burial goods or services.

Now, the House Energy and Commerce Committee will consider the bill, likely after the Easter recess. If H.R. 3655 passes the House Energy and Commerce Committee, it will move to the House of Representatives for debate and a vote

Funeral Industry Websites ignoring New National Industry Legislation-YourFuneralGuy

ConnectingDirectors.com did not do a story this past week on Funeral and Cemetery Legislative reform.

Several Funeral Industry Websites are ignoring the Funeral and Cemetery Reform hearing that took place in Congress this past week. Connecting Directors.com did not do a story or even post a news article.   FuneralWire.com has no article on the current story,only a mention of the NFDA support letter of 11/13/09. Now to ignore the biggest story on the  Funeral and Cemetery Reform legislation since the revision of the Funeral rule(law) in 1992 is flat out bias. Even Financial trading companies are reporting on the hearings-research.scottrade.com

Illinois Politicos try to cremate Comptroller on Burr Oak Cemetery Scandal-YourFuneralGuy

It appears that some  Illinois Politicians are trying to throw Dan Hynes into the Cremation chamber.

Political Leaders tried to cremate  candidate Hynes on the Burr Oak Cemetery Scandal at an SEIU Rally Saturday. The Burr Oak Cemetery Scandal, may be the worst in the Nations History.

Evidence Surfaced that Hynes knew about the Scandal in 2003 on Friday Night in both a  Burr Oak Cemetery Memo and a Illinois Office of Comptroller(IOC) Memo.

Quinn keeps hammering on Hynes incompetence on the Burr cemetery situation in a tv ad.

Hynes said he tried to encourage the owner of Burr Oak Perpetua  Inc. to do the right thing. but the revealed memo shows a cover up  of Grave desecration by the Company.

We tried to point [Perpetua] in the right direction to make sure they were following proper channels,” Hynes said.

Hynes  “not my job” response in the Burr Oak Cemertery Scandal  may cost him  the nomination for Governor. Political candidates are not the real culprits here, but  the Perpetua Company  and it’s owners are.

Following a get-out-the-vote rally with members of the Service Employees’ International Union, Quinn alleged Hynes knew of improper disposal of human remains and didn’t do anything about it.

“They were given specific information that they knew, that they acknowledge there were human remains not properly disposed of at the cemetery,” Quinn said. “Now the proper thing to do would have been to immediately investigate that, as he did with other cemeteries in Illinois, but they decided not to do anything. And I think they owe the people an explanation for why not and an apology for not acting properly.”

Rush, an African-American congressman from the South Side, said Hynes’ failure to act earlier was a disservice to the black community.

“He was so uncaring, so callous, so cavalier that he didn’t even lift a finger. Didn’t bat an eye, didn’t do anything,” Rush said. “The gall of this man to come now to ask for our votes for governor– when he has been probably the most callous comptroller in the history of this country when it relates to the pain and suffering of our community.”
