NPS “Preneed” Court-YourFuneralGuy

National Prearranged Services(NPS) is back  in court over  Funeral Fraud  in the amount 600 million dollars. At issue is a court injunction and the owners spending the funds they received from the Fraudulent Preneed Contracts.

State insurance Guaranty associations who have guaranteed the the  funeral funds to the consumers have brought the lawsuit against the  owners.

At issue is whether spending of funds that can be recovered will be curtailed.

The topic in the federal courtroom on Wednesday was money, specifically what happened to $600 million and whether a federal judge should be watchful to make sure even more money doesn’t go missing.

No one disputes that the money is gone,” attorney Daniel Reilly told the federal judge. “But the defendants never say where that money went.”

The defendants in this case were the Cassity family, owners of a once-celebrated funeral services company in Clayton and a web of affiliated companies. They ran National Prearranged Services and Forever Enterprises, plus two life insurance companies.

Preneed Contracts, White out, Lawsuits| Close Funeral Home-YourFunreralGuy

National Prearranged Services Preneed Contracts, and the NPS National Prearranged Lawsuit has closed down a Funeral Home. The Main tool in this fraud was white out. It’s all about Mount Washington National Forever Funeral Home in Independence, MO.

Although the lawsuit is for 600 Million USD estimates of the NPS Scam

The funeral home was receiving no money to try and fund pre-need contracts that families had with a company previously managing the home, said Duke Radovich, chief executive officer of Charter.

Pre-need burial and funeral services involve a pre-payment by the customer in exchange for the promise that funeral services will be provided at no further cost when the customer dies.

National Prearranged Services went to different funeral homes, offering to sell prearranged funeral services and to manage the money from the pre-need contracts.

The problem was that National Prearranged Services was sued in federal court for $600 million, alleging the company preyed on consumers and funeral homes to perpetuate a multi-million dollar, nationwide scheme from the sale of pre-need contracts.

The suit looks to recover costs expended by plaintiffs and seven state insurance guaranty companies.

George Steinbrenner will have a  a private family funeral service on Saturday in Tampa,

Later on there will be a public  Memorial Funeral at the George M Steinbrenner field, the spring training home for the New York Yankees.  There is also a memorial planned for New York.

George Steinbrenner’s family is planning for a small private funeral for the immediate family that is likely to be held Saturday in Tampa, according to people close to the Yankees owner who died early Tuesday morning after a heart attack in his adopted hometown of Tampa.

There will be memorials held at George M. Steinbrenner Field, formerly called Legends Field, the Yankees’ spring training home in Tampa and later in New York, where dignitaries will honor the man

Quietly  and for a while now Service Corporation International (NYSE:SCI) has been blogging for Funeral Dollars.

The World’s largest funeral corporation in NC  is putting out some interesting blog posts for its funeral homes in  NORTH CAROLINA.

Do not be fooled there are lies in there too.

No funeral insurance (Preneed, Prepaid) can guarantee coverage because no investment in today’s market can be guaranteed. No one can lock in today’s prices anymore. No one can say that will happen.

The absurdity of the statement  “it( funeral Insurance) cannot be denied to you because of pre existing health benefits.” This sounds good at first but it is an apple and oranges comparison.

Funeral  insurance is a purchase of funeral goods and service that is put into an insurance or other investment vehicle. Life insurance refers to payment of monies upon your death. They are quite different things.

Will the World Largest Funeral Corporation start “STATE BY STATE”   Funeral Blogs as it did  for it’s Funeral Homes in North Carolina? It is quite possible they have already done this. this tactic is an indication of funeral industry decline, and the declining funeral cost to the consumer.

The recent NPS, Illinois Funeral Directors Association Preneed Scandal and the California Funeral Directors Association Scandal is reason enough to avoid funeral preneed.

Your Funeral Guy:What Country will have #1 GreenCremationMachine?

What country in the world will have the 1st Green Cremation Machine? There are reports of the green cremation, alkaline hydrolysis, resomation, water resolution  machines going into the USA, Canada, Australia, Belgium, Mexico, The UK and Scotland.

In the United States alone reports have surfaced of the machine going into California, Washington State, Florida, Illinois, Minnesota and Maine. There does seem to be a race among Funeral Homes in the US to be the first to place a  green cremation machine into Operation. The funeral home anywhere in the world that is first will certainly get much free publicity.  It is also rumored that the Neptune Society has purchased a Machine.

A machine could be in place any time this summer or this fall. There are some negatives however as recent press reports indicate.

UNDERTAKERS could dissolve corpses in chemicals then flush the remains into the sewage system under plans being studied by European bureaucrats.

The controversial method has been hailed as a much more ecologically sound method of dealing with the dead.

But critics have branded the procedure, driven by a Scottish company, as “disturbing” and claim it shows no respect for the recently departed.

No Change One Year later, Burr Oak Cemetery Scandal-YourFuneralGuy

Sadly  one year after the Burr Oak Cemetery  Scandal not much has changed. Perpetua, Inc, the company responsible for the disaster is still in charge. The Four people arrested have not gone to court. The gate has been changed. There is no resolution of grief for the families involved. Recovered remains have not been identified or even tested, nor will they be.

Illinois does have a new cemetery Law  and possibly effective  Cemetery Oversight. (Click Here for More)National legislation, the Bereaved Consumers Bill of Rights Act, HR 3655 seems to be stalled in Congressional Committee.

Burr Oak is of special significance to African-Americans in Chicago. It was one of the first cemeteries to allow blacks to bury their loved ones, and many African-Americans still opt to have their relatives laid to rest there.

Burials resumed at the cemetery in November. But they have not all gone smoothly, said Sheriff Tom Dart, whose office uncovered the alleged grave-reselling scheme. Dart said his detectives found hundreds of human bones, but there is no way to identify the bodies.

“I feel confident the people who have been charged will be convicted,” Dart said. “But true justice, I don’t think (the families) will ever get the complete closure and sense of justice they deserve.”

Since the cemetery reopened, there have been more than 200 new burials, said Randy Sanderson, chief financial officer of Perpetua Holdings. He said there has been a steady stream of visitors since the cemetery reopened, and the staff helps relatives find gravesites, now that the cemetery has been better organized.

While it was closed, officials relabeled sections of the cemetery and placed new markers on the grounds.

“I believe we have come a long way in terms of assuring folks that their loved ones were not disturbed,” Sanderson said. “It may only be a handful of families that have some doubt. But hundreds of families have come here since November, and they leave here satisfied.”

Nevertheless, a sense of distrust and betrayal remains with some.

Green cremation, Alkaline Hydrolysis, Resomation, receives unjust Criticism-yourfuneralguy

There has been some negative press of late on alkaline hydrolysis and  the new green cremation, procedure known as resomation. It appears to me that some in the press have not taken the time to understand the process. By not investigating the process and simply attacking the aesthetics involved, a green innovation is receiving unjust criticism.

Here is one recent Headline:

“Belgium’s plan to wash its dead down the drain: Bodies would be dissolved in caustic solution… and flushed into the sewer

It could hardly be said to be the most dignified of send-offs.

Undertakers in Belgium plan to eschew traditional burials and cremations and start dissolving corpses instead.

The move is intended to tackle a lack of burial space and environmental concerns as 573lbs of carbon dioxide are released by each cremated corpse.

Many of the comments on this article cried Solyent Green is people, an expected response given the 1970 movie “Fahrenheit 451″  Here is Your Funeral Guys comment at the site.
“The soylent green response to this process is quite expected. The Fluid does not half to go down the drain, although the fluid is safe if not welcome in sewage treatment plants. No one eats the remains, in this process. In fact green cremation-resomation- is  the most green alternative for disposition available in the world today.

Talk about not giving a proper burial to a beloved one, the Belgium government plans to wash its dead bodies down drains as the corpses would be dissolved in a caustic solution and then flushed into the sewer.

The media needs to fully investigate before presenting the negative side of a new innovation. The publics perception will change once the aesthetics are perceived correctly, the cost benefit  to the family is presented as well as the benefits to the earth.
